Confused? Dozvola (Permit) vs. Elaborat (Technical Report) — Here's the key difference for legalization.

What do 9 out of 10 property owners in Montenegro get wrong?

👉 A Permit (Dozvola) and a Technical Report (Elaborat) are two completely different things.

🏗️ The Dozvola (Building/Use Permit)

This is the official government permit to build.
It relates to the original project plans: what you were allowed to build and how. If a building was constructed without a dozvola or differs from the plans, a note appears in the cadastre (Property Deed/LN):
"Nema dozvolu" (No permit), or "Objekat nije izgrađen u skladu sa zakonom" (The building was not constructed in accordance with the law).
➡️ The bottom line: A property like this is considered unauthorized.

📐 The Elaborat (As-Built Technical Report)

This is a technical document prepared by a licensed surveyor.
It records the property's actual, current condition: the layout, dimensions, position on the land plot, and photographs.
An Elaborat is required to file a Protective Application or for the full legalization process. On its own, it doesn't grant any ownership rights—it only describes the physical reality of the building.

⚖️ The Takeaway

  • A Dozvola = The Past (the original government permission).
  • An Elaborat = The Present (a description of the property as it stands today).
A property without a Dozvola always carries the risk of fines and transaction blocks.
But it's the Elaborat that allows you to file a Protective Application and enter your property into the legalization process.
